Israel Producten Centrum beboet wegens fout etiketteren nederzettingenproducten

“Een bescheiden begin van handhaving van het internationaal recht ten behoeve van het Palestijnse volk”

Op 12 april maakte het Israel Producten Centrum(IPC) in Nijkerk bekend dat het een boete van €2100 heeft gekregen van de Nederlandse Voedsel- en Waren Autoriteit  wegens foute etikettering van nederzetting wijnen. De eis van docP-BDS Nederland dat IPC zijn overtreding van EU etiketteringsregels zal staken is hiermee als terecht erkend.

Het betrof de verkoop van wijnen uit Israels illegale nederzettingen alsof deze afkomstig waren uit Israel. Een kort overzicht van de gebeurtenissen: In april 2019 kreeg het Israel Producten Centrum (IPC) van Christenen voor Israel in Nijkerk bezoek van de Nederlandse Voedsel en Waren Autoriteit (NVWA) en werd het op de vingers getikt vanwege het verkopen van producten uit illegale nederzettingen als zijnde “Israelische producten”.  Volgens EU richtlijnen moeten verkopers van dergelijke producten op het etiket duidelijk maken dat deze afkomstig zijn uit een Israelische nederzetting in bezet Palestijns gebied.

In december 2019 legde een scouting missie van BDS Nederland tijdens een “feestelijke verwenavond” georganiseerd door IPC bloot dat het IPC nog altijd ten onrechte nederzettingswijnen te koop aanbood met het etiket ” Israel”. Op de avond van 19 december 2019 lieten daarom twaalf boycotactivisten uit verschillende delen van ons land bij het IPC in Nijkerk een luid protest horen tegen de promotie van dergelijke producten.

Op 10 februari organiseerde BDS Nederland een briefschrijfactie, waarin lezers van onze nieuwsbrief  met één klik konden schrijven naar zowel de FIOD (wegens vermoedens van ontduiking van importheffingen)  als de NVWA (wegens foute etikettering). Deze actie was tegen het zere been van IPC, die een advocaat in de arm nam en dreigde met juridische actie. Met steun van ELSC hebben wij de NVWA duidelijk kunnen uitleggen waarop wij onze actie hebben gebaseerd. De tegenpartij heeft zijn dreigement vervolgens niet waargemaakt.

De NVWA organiseerde in juli 2020 een herinspectie bij het IPC. De christenzionisten dachten weg te kunnen komen met de melding “afkomstig uit een Israelisch dorp in Judea en Samaria”, maar daar trapte de NVWA niet in. Integendeel, op 5 september stuurde de NVWA alle 300 activisten die hadden deelgenomen aan onze briefschrijfactie individueel het volgende bericht :

“Een inspecteur van de NVWA heeft het etiket beoordeeld en vastgesteld dat het etiket niet aan de wettelijke eisen voldoet. De NVWA heeft hiervoor een passende maatregel genomen. Wij danken u dat u de moeite heeft genomen om de NVWA op deze zaak te attenderen.”

Op 12 april maakte IPC bekend dat het op 9 april van de NVWA een brief van 12 kantjes had ontvangen als uitleg bij een boete van €2100 wegens fout etiketteren van wijnen uit de illegale nederzettingen. IPC kondigt nu aan in beroep te gaan, en maakt van de gelegenheid gebruik door niet alleen een protest emailactie te organiseren naar de NVWA, maar ook nog eens schaamteloos reclame te maken voor zijn illegale wijnen.

DocP-BDS Nederland is verheugd met de actie van NVWA, die laat zien dat deze instelling de regelgeving van de EU en Nederland rond etikettering respecteert, resulterend in het beboeten van het IPC voor zijn illegale werkwijze. De boete is miniem vergeleken met de grote schade die het Palestijnse volk lijdt door de Israelische bezetting en onteigening van zijn grondgebied. Christenen voor Israel en het Israel Producten Centrum trekken al jaren lang groot financieel profijt uit de verkoop of liever heling van producten afkomstig van gestolen Palestijnse grond. Moge deze kleine boete een opmaat zijn naar verdere handhaving van het internationaal recht, het terugrollen van de nederzettingen-onderneming en het herstel van de rechten van de Palestijnen.

Israel Products Center fined for incorrect labeling of settlement products

“A humble beginning of enforcement of international law for the rights of Palestinians”

On April 12, the Israel Products Center in Nijkerk announced that it had been fined € 2,100 by the Dutch Food and Consumer Product Safety Authority (NVWA) for incorrect labeling of settlement wines. This has settled a dispute between docP -BDS Netherlands and the Israel Products Center in favor of the BDS movement.

The dispute involved the sale of wines from Israel’s illegal settlements as if they were from Israel. A brief overview of the events: In April 2019, the Israel Products Center (IPC) of the Christians for Israel in Nijkerk was visited by the Dutch Food and Consumer Product Safety Authority (NVWA) and was reprimanded for selling products from illegal settlements as being “Israeli products”. According to EU guidelines, sellers of such products must make it clear on the label that they come from an Israeli settlement in Palestine.

In December 2019, a scouting mission of BDS Netherlands during a “festive indulgence evening” organized by IPC revealed that the IPC still offered settlement wines for sale with the label “Israel”, when in reality they came from Israeli-occupied Palestinian territory. On the evening of December 19, 2019, twelve boycott activists from various parts of our country therefore voiced a loud protest at the IPC in Nijkerk against the promotion of such products.

On February 10, BDS Netherlands organized a letter writing campaign, allowing readers of our newsletter to write with one click to both tax inspection office FIOD (due to suspicions of import tax evasion) and the NVWA (due to incorrect labeling). This action was against the sore leg of IPC, which hired a lawyer and threatened legal action. With the support of ELSC, we have been able to clearly explain to the NVWA on which premises we have based our action. The IPC lawyer subsequently failed to live up to its threat.

The NVWA, which received more than 300 emails from our supporters, organized a re-inspection at the IPC in July 2021. The Christian Zionists thought they could get away with the label “coming from an Israeli village in Judea and Samaria”, but the NVWA did not fall for that. On the contrary, on September 5, the NVWA individually sent the following message to all who had participated in our letter writing campaign:

“An inspector from the NVWA has assessed the label and determined that the label does not meet the legal requirements. The NVWA has taken an appropriate measure for this. We thank you for taking the trouble to draw the attention of the NVWA to this matter. ”

On April 12, IPC announced that on April 9 it had received a 12-page letter from the NVWA explaining a fine of € 2,100 for incorrectly labeling wines from the illegal settlements. IPC announced that it would appeal and used the opportunity by not only organizing an email campaign to the NVWA, but also shamelessly advertising its illegal wines.

DocP-BDS Netherlands is pleased with the action of NVWA, which shows that this institution respects the regulations of the EU and the Netherlands on labeling, resulting in IPC being fined. The fine is minimal compared to the great damage suffered by the Palestinian people through the Israeli occupation and expropriation of its territory. Christians for Israel and the Israel Products Center have long benefited greatly from the sale, or rather the fencing, of products derived from stolen Palestinian land. May this small fine be a prelude to stronger enforcement of international law leading to the rollback of the settlement enterprise and the restoration of the rights of the Palestinians.
